South Africa: Future Mining Charter Court Ruling: Implications for IOCs

On 31 March Minister of Mineral Resources Ngoako Ramatlhodi announced that a key component of the government’s BEE policy would be referred to the High Court to resolve a long-running disagreement between the government and mining sector. According to Ramatlhodi, who spoke at a press conference on compliance with the Amended Broad-Based Socioeconomic Empowerment Charter for the South African Mining and Minerals Industry (the Mining Charter) an urgent ex parte application will be jointly made by the Department of Mineral Resources (DMR) and the Chamber of Mines to seek High Court clarification on how the principle should be interpreted.
