South Africa: ELA Case Complicates Environmental Authorizations

On 8 March ELA won its legal challenge against the environmental authorization of a new coal-fired IPP on the grounds that the climate change implications have not been properly considered. Minister of Environmental Affairs Edna Molewa will now be required to reconsider ELA’s appeal against the Department of Environmental Affair’s approval of the project. For IOCs, especially those interested in the gas-to-power IPP program, the ELA case has several implications. It highlights that climate change is an increasingly important issue and the likely focus of increasing NGO activity.
